The plaintiff claims he worked at least 49 hours per week for Iron Container without being paid appropriate overtime.
Iron Container, LLC and the Miami-based company’s owner face a proposed collective action wherein the plaintiff says he’s owed unpaid overtime wages. The plaintiff worked for the defendants as a laborer from August 2013 through March 2017, the lawsuit says. The man reportedly worked 49 hours per week without being paid time-and-a-half wages for every hour worked beyond 40 as required under the Fair Labor Standards Act (FLSA).
The complaint notes that in October 2017, the plaintiff, through his legal counsel, presented the defendants with a written pre-suit demand pertaining to his allegedly unpaid overtime wages. The defendant “failed/refused” to remit the requested amounts, the lawsuit says.
