The four operating companies of Manhattan Indian restaurants Benares and Aangan, along with two individual owners, have been named as defendants in a lawsuit that claims they failed to pay their employees proper wages and denied them required wage statements. The plaintiff, a former server at one of the restaurants, says he often worked more than 50 hours per week and was paid a fixed rate per shift without receiving overtime or spread-of-hours wages. Additionally, the suit argues that servers’ tips were unlawfully shared with managers who do not customarily receive tips.
The plaintiff says the defendant also failed to keep an accurate record of his hours worked and neglected its obligation to provide him with wage statements that detailed his hours and rates of pay.
