A proposed collective action has been filed in New York against Huntington Plumbing Supply Co., Inc. and two owners by a man who says he wasn’t paid properly for his overtime hours.
A proposed collective action has been filed in New York against Huntington Plumbing Supply Co., Inc. and two owners by a man who says he wasn’t paid properly for his overtime hours. According to the complaint, the plaintiff worked approximately 56 hours per week and was paid entirely in cash throughout his employment. He never received, however, any additional pay for hours worked over 40 per week in violation of the Fair Labor Standards Act and New York labor laws, the suit claims. The case says the man’s job duties included managing inventory, assembling orders and driving the forklift– work that allegedly did not involve executive or administrative responsibilities. As a result, the case claims, the plaintiff should have received time-and-a-half pay for his overtime hours.
