Filed: September 28, 2017 ◆§ 3:17-cv-00191-MPM-RP
Huddle House, Inc. is facing a proposed collective action that claims it failed to pay its general managers proper overtime wages.
Huddle House, Inc. is facing a proposed collective action that claims it failed to pay its general managers proper overtime wages. The three named plaintiffs allege that they regularly worked at the defendant’s Huddle House restaurants as general managers for more than 40 hours per week but were deemed exempt from overtime wages despite performing essentially the same duties as non-exempt employees. The suit claims the defendant’s pay structure was “a scheme to save payroll costs and payroll taxes” by requiring exempt employees to perform duties that should have been assigned to non-exempt workers. As a result, the plaintiffs argue, the defendant has “unjustly enriched itself” and must pay proposed class members the wages owed them.
