Rodriguez v. Hospitality Staffing Team Llc
Filed: December 29, 2017 ◆§ 1:17cv24719
A former employee claims Hospitality Staffing Team LLC owes him around 14 weeks' worth of unpaid overtime.
Hospitality Staffing Team LLC is on the receiving end of a proposed class action filed by a former employee who claims he’s owed roughly 14 weeks’ worth of unpaid time-and-a-half overtime wages. The plaintiff claims he worked for the defendant as a maintenance employee from July 2017 through November 2017, during which, the case says, he worked an irregular schedule of anywhere from 45 to 112 hours per week, often seven days per week. The complaint states the plaintiff was incorrectly classified as an independent contractor by the defendants, even though he was provided with paystubs showing taxes were withheld from his pay.
By the complaint’s estimate, the defendant owes the plaintiff more than $3,000 in unpaid overtime.
