New Rochelle, New York’s Hometown Restoration, LLC and two individuals with control over the company face a proposed collective action in which the plaintiff claims he’s owed unpaid overtime wages. Employed by the defendants from May 2012 through May 2017, the plaintiff alleges he typically put in 57 hours per week performing general construction work without being paid time-and-a-half overtime for each weekly hour worked in excess of 40. The plaintiff claims that throughout his tenure with the defendants, he was paid his wages in cash and was never required to keep track of his work time.
