Alpha Home Health Agency, LLC has been named in a proposed collective action filed by a former home health aide who claims she and other employees were misclassified as exempt from receiving overtime wages. According to the complaint, the U.S. Department of Labor extended overtime protections to home care workers effective January 1, 2015, after which the defendant was required to begin paying its employees time-and-a-half wages for hours worked over 40. The case argues that despite the rule, the defendant continued paying home health aides at their straight-time rates for all hours worked. The plaintiff claims she put in between five and 10 hours of overtime per week and is owed premium wages for those hours.
