Home Care One and the company’s president have been named in a lawsuit filed by a former employee who claims she was not paid for all time worked.
The plaintiff was employed as a home health aide at the company from August 2018 until her resignation in October, according to the suit. The defendants allegedly failed to pay the woman time-and-a-half wages for weeks in which she worked regularly worked anywhere between 50 and 84 hours. For some weeks at the end of her employment, the suit says, the plaintiff received no wages at all for hours worked in excess of 40.
The case goes on to charge that the plaintiff received an inaccurate final paycheck in the mail following her resignation. After complaining to the defendants about her underpayment, the woman claims she was told the company would send “another check when they administered payroll the following week,” but never received any further payment.
