Hogan’s Bridge, LLC and its president have been accused in a new proposed class action of misclassifying employees as independent contractors and failing to pay them overtime wages.
Hogan’s Bridge, LLC and its president have been accused in a new proposed class action of misclassifying employees as independent contractors and failing to pay them overtime wages. The defendants, who are “primarily engaged in the care of the sick or the aged,” employed the plaintiff as a personal support coordinator between June 2016 and November 2017, according to the complaint. The plaintiff says he worked more than 40 hours per week but was not provided with time-and-a-half premium wages as a result of his alleged misclassification as a contractor.
The suit further claims the defendants committed fraud by improperly reporting the plaintiff’s wages and employment tax information to the IRS. From the complaint:
“Defendant voluntarily and intentionally issued Plaintiff an IRS Form 1099 for the remuneration listed therein in an attempt to evade paying federal income tax on such sums, in violation of its legal duty to deduct applicable employment taxes from Plaintiff’s wages and to accurately report these wages to the IRS.”
