New York
Highline Building Services, LLC and Strategic Outsourcing, Inc. are facing a lawsuit filed by a former employee who claims he was not paid proper overtime wages while performing cleaning services for the defendants. According to the complaint, the plaintiff’s hourly rate ranged from $13.00 to $18.00 per hour, “sometimes in the same workweek.” The defendants allegedly failed to calculate his time-and-a-half overtime rate using the weighted average of his weekly pay rates, causing him to be underpaid for the hours he worked above 40 each week, the suit says.
On top of that, the complaint argues, the defendants failed to provide employees with required wage notices and accurate wage statements for each pay period.
