Last Updated on May 8, 2018
Francoeur et al. v. Higg’s Painting, Inc. et al.
Filed: October 27, 2017 ◆§ 1:17-cv-00498
Three fmr. employees claim Higg's Painting failed to pay them overtime and prevailing wages/benefits for public works projects in Mass. and Rhode Island.
A proposed class action filed by three plaintiffs alleges defendants Higg’s Painting, Inc. and the company’s owner owe unpaid time-and-a-half overtime, as well as unpaid prevailing wages and benefits for public works projects in Rhode Island and Massachusetts.
The plaintiffs, who the case says worked as painters for the defendants at various times between 2011 and as recent as September 2017, claim they were paid between $18 and $20 per hour worked without receiving time-and-a-half pay for all hours worked past 40 each workweek. For public works projects, the case continues, the plaintiffs and similarly situated workers were still only paid between $18 and $20 per hour no matter how many hours they worked.
