Estefes v. Dorm Delicatessen Corp. et al
Filed: January 11, 2018 ◆§ 1:18cv242
Dorm Delicatessen Corp. (which does business as Heavenly Market & Deli) and an individual owner are facing a lawsuit that accuses the defendants of violating state and federal labor laws.
New York
Dorm Delicatessen Corp. (which does business as Heavenly Market & Deli) and an individual owner are facing a proposed class and collective action that accuses the defendants of violating state and federal labor laws. According to the complaint, the plaintiff was employed at the market and deli as a cook between April and August 2017. He claims he regularly worked approximately 62 hours per week and was paid a fixed weekly salary of $750 in cash regardless of his actual hours. The suit argues that the plaintiff should have received time-and-a-half overtime wages and spread-of-hours wages in accordance with the Fair Labor Standards Act and New York labor law.
Furthermore, the complaint claims the defendants failed to provide the plaintiff with accurate wage statements and notices that informed him of his rights as an employee.
