Healthy & Beauty Way and its owner find themselves as defendants in a lawsuit filed by a former masseur who claims she put in 80.5 hours each week at the spa without proper overtime wages.
Healthy & Beauty Way and its owner find themselves as defendants in a proposed collective action filed by a former masseur who claims she put in 80.5 hours each week at the Maywood, New Jersey spa without proper overtime wages.
The plaintiff worked for the defendants from March 2013 to November 2018 and was paid “on a pure commission basis” that provided her with 50 percent of the price charged to her customers, according to the case. The complaint says this amounted to an income of about $4,000 per month, which allegedly failed to account for time-and-a-half of the minimum wage or her calculated hourly rate for the hours she worked over 40 each week.
