A proposed collective and class action citing claims of unpaid overtime has been filed against HCL America, Inc.
According to the complaint, the plaintiff worked as a systems specialist for the IT services company. The man alleges that he was wrongly classified as exempt from overtime wages and that he regularly put in between 40 and 50 hours each week without appropriate time-and-a-half pay. Specifically, the suit claims the plaintiff was paid just half his regular hourly rate for overtime hours worked.
