Harris Water Main & Sewer Contractors and the company's top execs are facing a lawsuit alleging violations of the Fair Labor Standards Act's overtime rules.

Four plaintiffs have filed a proposed class and collective action against New York City’s Harris Water Main & Sewer Contractors, Inc. and its president and vice president over alleged Fair Labor Standards Act (FLSA) wage and hour violations. The allegations in the 23-page complaint run the gamut from the defendants’ alleged failure to pay regular and overtime wages and reimburse workers for uniform costs and related maintenance, to their alleged practice of making unlawful deductions from paychecks and retaliating against workers who complained about unpaid wages.
The plaintiffs, i.e. crew members/field employees who perform manual labor, allege they were “instructed, directed, and/or permitted” to work off the clock without pay, and had one hour per day deducted from their wages for a meal period the lawsuit claims proposed class members regularly had to work through.
