Seven plaintiffs are behind a proposed class action against North Carolina’s Ham Farms, LLC and three other companies over allegedly unpaid wages dating back to the 2015 and 2016 agricultural seasons. The 83-page lawsuit, which also names as defendants Hugo Martinez Gutierrez Harvesting, LLC; 5 G Harvesting, LLC; and three individuals who help provide migrant agricultural workers, claims the entities violated the Fair Labor Standards Act (FLSA) and North Carolina wage laws by failing to pay proposed class members – sweet potato harvesters – all wages when due at the proper minimum and overtime rates.
