The companies and individuals who operate New York City’s Haandi Restaurant are facing a proposed collective action filed by three former or current kitchen employees seeking allegedly unpaid wages.
The companies and individuals who operate New York City’s Haandi Restaurant are facing a proposed collective action filed by three former or current kitchen employees seeking allegedly unpaid wages.
The first plaintiff, who was employed as a cook and cashier, says he was paid between $500.00 and $550.00 per week while working a 60-hour schedule. Similarly, the second plaintiff claims he worked the same number of hours performing cooking, cleaning, dishwashing, and various other kitchen duties and was paid between $550.00 and $650.00 throughout his employment. Both men argue that they were never provided with time-and-a-half premium pay for their overtime hours.
The last plaintiff – a dishwasher, server, cleaner, and general helper – claims he still works for the defendants and recently began receiving a weekly salary of $425.00 for working 60 hours. According to the case, he was previously paid $400.00 per week for more than 15 years – an amount that when divided by his hours worked fell well below the minimum wage and failed to include overtime pay.
The case argues that besides minimum, overtime, and spread-of-hours wages, the defendants also failed to provide their workers with accurate wage statements and notices in accordance with state law.
