Benitez v. Green Acres Farms, Inc. et al.
Filed: October 16, 2017 ◆§ 1:17-cv-06025-KAM-VMS
A former employee claims NY companies Green Acres Farms and Empire Supermarket, Inc. owe unpaid overtime and failed to post mandatory notices in the workplace.
New York
A proposed collective action out of New York alleges Green Acres Farms, Inc., which does business as Green Acres Farms; Empire Supermarket, Inc., operating as Key Food #1368; and two individuals with control over the Brooklyn businesses owe unpaid overtime. The plaintiff, who the case says worked as a meat and poultry packer for the joint-employer defendants from around 2010 through March 2014 and from August 2016 through August 2017, alleges she worked roughly 54 hours per week without being paid time-and-a-half overtime wages. The plaintiff claims the defendants further violated the Fair Labor Standards Act (FLSA) by failing to post mandatory minimum and overtime wage notices in the workplace.
