Great South Timber and Lumber, LLC is facing a former employee’s claims that the company denied him proper pay and fired him in retaliation for taking time off work due to a medical emergency.
Great South Timber and Lumber, LLC is facing a former employee’s claims that the company denied him proper pay and fired him in retaliation for taking time off work due to a medical emergency. According to the lawsuit, the plaintiff was hired in September 2014 as a machine operator and was routinely required to spend time working “off the clock” without being paid for those hours. He further alleges that he and other employees were never provided with time-and-a-half premium wages for any hours they worked in excess of 40 each week.
The plaintiff claims in September 2017, he informed his employer that he suffered from a health condition that required him to receive emergency care and be out of work for three days. Instead of granting him unpaid leave under the Family and Medical Leave Act, the defendant allegedly terminated the plaintiff and never gave him his last paycheck.
