A proposed class action filed in Mississippi alleges assisted living company Grace and Mercy Personal Care and Respite Services, LLC has failed to pay individuals employed as personal care attendants (PCAs) proper overtime wages. The plaintiff, who worked for the defendant from 2014 through May 2017, claims the company incorrectly classified her as an employee exempt from Fair Labor Standards Act (FLSA) protections. The woman alleges she worked up to 50 hours per week without being paid time-and-a-half hourly overtime wages for all hours worked past 40.
