Cash handling service Garda CL Southeast, Inc. has been hit with a proposed collective action over claims of unpaid overtime wages and retaliation.
The plaintiff behind the lawsuit allegedly put in at least 50 hours each week as a vault worker at the defendant’s Orlando location. The woman claims she improperly received straight-time pay for all hours worked, including overtime hours for which she should have been compensated at a time-and-a-half rate.
The suit further alleges the plaintiff was fired “in direct retaliation” for complaining about being harassed by a manager. According to the case, the plaintiff was given a raise that her branch manager said she could keep “only if she would acquiesce to his romantic/sexual advances.” From the suit:
“[The manager’s] advances consisted of sexually suggestive test messages and inappropriate behavior at work, such as staring at Plaintiff and making kissing sounds. [The manager] also admitted to watching Plaintiff of the security cameras at work.”
The suit alleges that after his advances were rejected, the manager “became extra critical” of the plaintiff’s work performance and fired her “soon after” she reported his alleged conduct.
