The four companies and one individual that operate Gallito’s Kitchen in Brooklyn are the defendants in a proposed collective action filed by a former cook who claims the Mexican restaurant failed to pay appropriate wages for any hours worked. The plaintiff, who worked for the defendants from November 2015 through October 2017, alleges that at various times throughout his tenure he worked anywhere from 61 to 73 hours per week without being paid proper minimum, overtime or spread-of-hours wages. The plaintiff further claims the defendants—Gallitos Mexican Urban Kitchen Inc.; Bahar Mit Rana Rest Corp.; AQSA Food Corp.; Bahar Rest Corp. and the companies’ owner—required him to start working two to three hours before his scheduled shift start time, and up to one and a half hours past his departure time, without commensurate pay.
