A former laborer alleges two Bronx, NY furniture stores failed to pay proper time-and-a-half hourly overtime wages and maintain accurate time records.
Two Bronx furniture stores and their owner are on the wrong side of a proposed collective action in which the plaintiff, a former laborer, claims he was not paid proper time-and-a-half overtime or minimum wages. The lawsuit against Toys Outlet Inc., which operates as Furniture Express, and Izzy Furniture Inc. alleges the companies violated the Fair Labor Standards Act (FLSA) by both failing to pay proper wages and failing to maintain accurate records of employees’ work time. The plaintiff claims that between July 2011 and September 2017 he, depending on the time of year, worked between 70 and 84 hours per week for the defendants for a fixed salary that never varied based on the hours he worked.
