New York City’s Fratelli Pizza & Wine Bar and its owners are the defendants in a class action filed by a former delivery worker who claims he and similarly situated employees were not paid mandatory minimum, overtime and spread-of-hours wages. The named plaintiff in the suit claims that although he ostensibly worked as a tipped delivery employee, he spent several hours each day—more than 20 percent of the day, the complaint says—performing non-tipped duties, including washing dishes, mopping the basement, taking out garbage, and stocking deliveries.
The lawsuit claims the plaintiff worked between 66 and 77 hours per week without meal or rest breaks over the course of roughly four years and was only paid a flat wage for his first 40 hours worked in each week. Additionally, the plaintiff was allegedly never notified that his tips would be included as an offset for his wages.
