Four plaintiffs claim Four Sue Love’s Travel Stops & Country Stores, Inc. owes them and other current and former workers unpaid overtime wages.

Three individuals formerly employed as operations managers by Love’s Travel Stops & Country Stores, Inc. have sued the company to recover allegedly unpaid overtime wages. Citing possible Fair Labor Standards Act (FLSA) abuses, the lawsuit alleges the plaintiffs, who worked at the defendants’ locations across Pennsylvania, Maryland, Indiana, Ohio and Oregon, regularly worked as many as 60 hours per week without over-40-hours time-and-a-half overtime pay. The case further claims that despite the plaintiffs’ job titles, they were improperly classified as employees exempt from FLSA coverage, as they handled no managerial responsibilities, such as hiring, firing, disciplining or directing the work of others.
At its core, the case claims the defendant misclassified the plaintiffs as a way to save on labor costs:
“[The defendant] knew or recklessly disregarded the fact that failing to provide sufficient resources in store labor budgets resulted in [the plaintiffs] and collective members (who were not paid overtime) to work more than 40 hours in a workweek and primarily perform manual and non-exempt duties during their workweeks, without receiving overtime compensation,” the case argues. “This allowed [the defendant] to avoid paying additional wages (including overtime) to the non-exempt store-level employees.”
