The plaintiff says he worked 70 to 75 hours per week from November to March—and 100 to 125 hours per week during baseball season—without proper wages.
An individual formerly employed as an x-ray technician and medical assistant by Performance Medical Services PLLC (Performance Health) has filed a proposed collective action against the sports medicine practice and two individuals to recover allegedly unpaid overtime compensation. The plaintiff, who the case says worked for the defendants from April 2015 through January 2018, claims he typically worked 70 to 75 hours per week from November to March—and 100 to 125 hours per week between April and October—without being paid time-and-a-half overtime for every hour worked past 40.
Though the case notes the plaintiff was paid an additional $600 to $1000 per week during baseball reason when he was required to travel, the man’s pay allegedly never varied when he was required to work later than his usual schedule.
“More specifically,” the case states, “[the plaintiff] was required to work an additional 30 to 50 hours per week during baseball season without the appropriate additional compensation.”
