A proposed collective action has been filed against Tandoori Nights, LLC by a former waitress who says she and other servers were paid no wages at all while working at the defendant’s restaurant and nightclub. The plaintiff claims she worked for the defendant between June 2017 and March 2018 and was paid only in tips received from customers. The case argues that the defendant violated federal and state labor laws by failing to pay employees at least the required minimum wage or the lowered tip-credit rate, which the lawsuit notes is subject to strict requirements that the defendant failed to meet.
