A New York man has filed suit against his former employers, Pirata Tapas, Inc. and three individual owners of the company, claiming they failed to comply with federal and state labor laws.
A New York man has filed suit against his former employers, Pirata Tapas, Inc. and three individual owners of the company, claiming they failed to comply with federal and state labor laws. The plaintiff says he was a cook at the defendants’ Italian restaurant Viale and often worked more than 40 hours per week without receiving proper overtime or spread-of-hours wages. He further claims the defendants failed to compensate him for some of the hours he worked, including a period between November 2017 and December 5, 2017 for which he says he was paid no wages at all.
On top of that, the suit argues that the defendants didn’t allow the plaintiff to take meal or rest breaks and required him to purchase uniforms and kitchen utensils at his own expense.
