Perez et al. v. Krispy Kreme of South Florida LLC
Filed: October 18, 2017 ◆§ 1:17-cv-23835-FAM
Two plaintiffs claim Krispy Kreme of South Florida LLC owe them and other truck drivers time-and-a-half overtime pay dating back to 2014.
Two truck drivers formerly employed by Krispy Kreme of South Florida LLC have sued the company over allegations that they and other doughnut transporters are owed unpaid wages. The plaintiffs, who the case says only drove in-state routes in Florida, were reportedly paid on a commission basis dependent on the amount of doughnuts and other food items they hauled each week. According to the complaint, from October 2014 to the spring of 2016 – when Krispy Kreme reportedly changed its payroll practices – the company failed to pay truck drivers proper time-and-a-half overtime for all hours worked over 40 each week. The plaintiffs say they worked an average of 65 hours per week during that time period without proper pay.
