Trailer Bridge, Inc. is facing a former employee’s claims that the company failed to pay him proper overtime wages in violation of the Fair Labor Standards Act (FLSA).
Trailer Bridge, Inc. is facing a former employee’s claims that the company failed to pay him proper overtime wages in violation of the Fair Labor Standards Act (FLSA). The plaintiff says he worked for the defendant in logistics sales and received a salary plus commission on sales he made. According to the complaint, the defendant misclassified the plaintiff as exempt from overtime pay. The man argues that he should have been classified as non-exempt since he did not have the authority to set prices or “change significant parameters in the system.”
The suit seeks to recover allegedly unpaid overtime wages for the plaintiff and all salaried employees who have worked for the defendant in logistics sales within the past three years.
