Former TJX Employee Files Lawsuit Over Allegedly Unpaid Wages Stemming from Off-the-Clock Work

A former TJX Companies retail employee claims non-managerial workers at some of TJX’s Staten Island and NJ stores were not paid proper overtime wages.
The TJX Companies, Inc. is on the receiving end of a lawsuit filed by a former retail employee who claims non-managerial workers in some of TJX’s Staten Island and New Jersey stores were not paid proper overtime wages.
According to the complaint, the plaintiff worked as a part-time associate on Staten Island from October 2011 through October 2014 before moving on to a role as a full-time coordinator for the defendant from November 2014 until December 2016. The woman then went on medical leave before being terminated in November 2017, the suit says. During her time as a coordinator, the plaintiff was required by TJX to work in excess of 40 hours per week, the lawsuit states, adding that during this period the woman put in between 42.25 and 54.9 hours per week.
The plaintiff alleges that she was required each day to perform unpaid off-the-clock work during her 45-minute lunch break. The woman additionally claims that when she worked the closing shift from 2:00 pm until 10:00 pm, TJX required her to perform roughly 15 to 30 minutes of more off-the-clock work related to closing down the store.
“[TJX] did not pay [the plaintiff] at any rate of pay for this off-the-clock work,” the lawsuit reads, “and thus not at her overtime rate for these many hours of work per week that were over forty hours, in violation of both the [Fair Labor Standards Act] and [New York Labor Law].”
