Former Technician Sues Filtrex Service Group Over Allegedly Unpaid Wages

A proposed collective action citing FLSA and AMWA violations has been filed against Filtrex Service Group and one individual with control of the business.
A proposed collective action citing Fair Labor Standards Act (FLSA) and Arkansas Minimum Wage Act (AMWA) violations has been filed against Filtrex Service Group, Inc. and one individual with control of the business.
The suit was filed by a former HVAC service technician employed by the company from March 2018 to July 2018. The plaintiff alleges he was compensated on a day-rate basis and did not receive time-and-a-half overtime for hours worked in excess of 40 each week.
“Plaintiff and other technicians received the same day rate regardless of the number of hours they worked in a day or work week,” the complaint explains.
According to the lawsuit, the defendants had full control over the plaintiff’s work schedule and required him, and other technicians, to work approximately 60 hours per week or more without lawful time-and-a-half overtime compensation.
