Two former Taco Bell employees claim in a proposed collective and class action that Colorado franchise operator Colomex, Inc. failed to pay appropriate regular and overtime wages.
The plaintiffs behind the suit worked as hourly paid employees at Taco Bell franchise locations in Colorado and held positions such as crew member, shift manager, and assistant general manager, the suit says. The case alleges that the defendant regularly required the workers to perform off-the-clock work before, after and during their shifts – for which they received no pay – and failed to provide legally required “duty free” meal periods. The case also claims the defendant unlawfully failed to pay the men and other hourly paid workers for breaks that lasted less than 20 minutes.
The lawsuit further charges that the defendant failed to include non-discretionary “performance” bonuses in shift managers’ and assistant general managers’ regular rates of pay for the purposes of calculating their overtime rates.
