A former employee of a Tampa, Florida Subway restaurant has filed suit against its operating company, Yujile, Inc., and an individual with control of the business.
A former employee of a Tampa, Florida Subway restaurant has filed suit against its operating company, Yujile, Inc., and an individual with control of the business. The plaintiff claims she worked for the defendants as a sandwich artist and was not paid proper minimum and overtime wages. Specifically, the suit alleges the plaintiff worked approximately 55 hours per week but was only compensated for the first 40 through payroll. She says she was paid at her straight-time rate for the hours above 40 and claims the money was “disguised as compensation for maintenance repairs, paid in cash or through another business entity.” According to the suit, this potentially illegal policy was an attempt to avoid Fair Labor Standards Act overtime requirements.
Even further, the plaintiff says she was required to work off the clock and was not paid for the time she spent after each shift cleaning her workspace, counting money in the register, and clearing away food.
