A former Healthcare Management Services employee claims the company failed to pay its registered nurses appropriate overtime wages.

A former employee of Healthcare Management Services, LLC’s Cheswick Rehabilitation and Wellness Center alleges in a proposed collective and class action lawsuit that he and similarly situated registered nurses were not paid proper wages.
The plaintiff, who the case says worked for the defendant from September 2016 through January 2018, claims he put in an average of more than 50 hours per week without being paid for all overtime hours worked.
“In fact, from the very first paycheck it became evident [the defendant] was not paying [the plaintiff] for all hours recorded and worked,” the complaint states.
According to the case, the plaintiff realized upon receiving his first check that a discrepancy existed between the number of hours he worked and the hours listed on his paystub. The man alleges the defendant falsified his pay records, reducing his actual hours worked to ensure his checks “only reflected the hours they wanted to pay,” and alleges this type of conduct became commonplace.
In December 2017, the plaintiff reportedly informed the Department of Labor that the defendant was doctoring employee records and withholding rightful overtime pay, the complaint says. The DOL, according to the suit, informed the plaintiff that it had already received complaints from other nurses, and that an investigation was underway.
The lawsuit later alleges the defendant stopped payment on the plaintiff’s paychecks in retaliation for his complaints.
