Four operating companies of New York restaurant 11 Hanover Greek and four individuals who control the business are facing a proposed collective action filed by former employees who claim the defendants violated several provisions of state and federal labor laws.
The plaintiffs in the case – a food preparer and two food runners – say they worked more than 40 hours per week without receiving proper minimum, overtime, and spread-of-hours wages. They allege that the defendants did not accurately record their hours or provide them with wage statements and notices. According to the complaint, the defendants deducted $20 each week from their wages for meal breaks they did not take and withheld about $100 of tips from the two food runner plaintiffs each day.
The food runners further argue that they spent more than 20 percent of each day performing non-tipped duties and should have been paid the full minimum wage instead of a tip-credit rate.
All three plaintiffs claim they were required to purchase articles of clothing – such as shirts, pants, and ties – to wear as uniforms without being reimbursed for their expenses.
