Four respective operating companies of Rancho Chico restaurants in South Florida and one individual have been named as defendants in a proposed collective action filed by a former Rancho Chico employee who claims he is owed unpaid overtime wages. The plaintiff in the case says he worked for the defendants as a server between approximately April 2006 and April 2016 and never received time-and-a-half overtime pay for the hours he worked beyond 40 each week. Citing alleged violations of the Fair Labor Standards Act, the suit claims the defendants unlawfully paid their employees a fixed salary regardless of how many hours they worked, ignoring federal overtime regulations.
