Six former employees of The Picnic Basket and Hokey Poké have filed suit against the eateries’ four operating companies and two individual owners over claims that they failed to comply with federal and state labor laws.
Six former employees of The Picnic Basket and Hokey Poké have filed suit against the eateries’ four operating companies and two individual owners over claims that they failed to comply with federal and state labor laws. The plaintiffs in the case say they worked for the restaurants as food preps, dishwashers, counter employees, and delivery employees at the defendants’ two Manhattan locations and were not paid proper overtime or spread-of-hours wages for the duration of their employment.
The plaintiffs claim their paystubs did not reflect all the hours they worked, and the tipped employees argue that the defendants withheld approximately 50 percent of the gratuities they received from customers. As a result, the suit seeks to recover allegedly unpaid wages and damages for the defendants’ supposed failure to provide accurate wage statements and notices.
