A former employee of Covelli Enterprises, Inc. has filed suit against the company over claims that it failed to pay her proper overtime wages during her employment at one of the defendant’s Panera Bread stores. The plaintiff says she was an assistant manager and often worked more than 40 hours per week without being paid time-and-a-half premium wages.
“Neither [the plaintiff] nor [proposed collective members] were professionals,” the lawsuit attests, adding that they “did not perform executive or administrative functions as defined by the [Fair Labor Standards Act], and they were not exempt from the overtime requirements of the FLSA or Ohio Revised Code.”
