Former Nail Salon Worker Sues Over Alleged Labor Law Infractions

A man claims he worked at Complete Nail and NY Nail & Spa in Schenectady, New York for 74.5 hours per week without receiving proper overtime or spread-of-hours pay.
Hui Yang Nails & Beauty Spa Inc. is facing a proposed collective and class action filed by a former employee. Also named as defendants are several individuals who operate the nail salon, which does business as Complete Nail and NY Nail & Spa in Schenectady, New York.
The plaintiff in the case says he worked for the defendants between February and July 2017 and was paid a fixed daily rate. Despite allegedly working 74.5 hours per week, the plaintiff claims he never received proper time-and-a-half overtime nor spread-of-hours pay. The man further alleges he was never notified of any tip credit that may have been applied to his wages. Even further, the plaintiff claims he had to pay the defendants $70 out-of-pocket for gas and electricity and was given a dormitory to share with other employees that was worth $1500 per month.
The lawsuit further argues that the plaintiff was not provided with proper meal and rest breaks and was unlawfully required to pay for approximately 12 boxes of gloves per month without being reimbursed.
