Four former employees of Mission Chinese Restaurant have filed suit against its operating company and three individuals with control of the business claiming the restaurant was 'a hotbed of racial discrimination' that denied its workers proper wages.

Four former employees of Mission Chinese Restaurant have filed suit against its operating company and three individuals with control of the business claiming the restaurant was “a hotbed of racial discrimination” that denied its workers proper wages.
The complaint starts out by claiming that the defendants were not permitted to apply a tip credit to employees’ wages because they never informed workers of the tip credit and required them to spend more than 20 percent of each shift performing non-tipped duties. On top of that, the case alleges, the defendants would sometimes alter time records to reflect fewer hours than were actually worked and didn’t pay out overtime wages when employees worked more than 40 hours in one week.
The suit then delves into a saga that describes an African American plaintiff’s struggles with alleged racial discrimination and the defendants’ supposed retaliation against her for complaining about their behavior. The complaint claims the three other plaintiffs were also retaliated against for siding with their co-worker and making their own complaints about the restaurant’s discriminatory culture. All four plaintiffs claim they were either terminated or had no choice but to resign from their employment as a result of the defendants’ actions.
