A former Healthcare Now Florida, Inc. and Cristobal R. Rosario, M.D., P.A. employee has filed suit against the parties over allegedly unpaid overtime wages. The plaintiff says she worked for the defendants between September 2015 and September 2017 as a non-exempt medical assistant. Despite requiring her to work more than 40 hours per week, the defendants failed to pay the plaintiff appropriate time-and-a-half overtime wages for each hour she worked over 40, the case alleges. The woman estimates that she was paid at her straight-time rate for approximately 220 overtime hours for which she should have been compensated at one-and-one-half times her regular pay rate.
