The ex-employee claims he worked 45 hours per week without being paid time-and-a-half overtime.
T.J. Maxx, Inc. finds itself as the defendant in a proposed collective action from a former loss prevention detective who alleges the retailer failed to pay proper overtime wages. The plaintiff claims he worked 45 hours per week across multiple T.J. Maxx locations in the Atlanta area, spending these five extra hours per week answering e-mails and responding to phone calls from his supervisor. According to the complaint, the plaintiff was never compensated for this off-the-clock work time, nor for time spent testifying or appearing in court due to his job responsibilities.
“[The plaintiff] was frequently called and e-mailed by his direct supervisor … despite being off-the-clock, and expected to respond to his supervisor’s needs at all times,” the lawsuit claims.
The lawsuit estimates the plaintiff is owed nearly $23,000 from T.J. Maxx in allegedly unpaid overtime.
