A former driver for Limo Express has filed suit against the company, as well as two individuals, alleging he worked without receiving proper minimum wage and overtime pay. During his employment, which lasted from September 2016 to March 2017, the plaintiff allegedly:

  • Was paid a flat rate per trip, depending on the destination
  • Had all of his tips withheld by the defendants
  • Received paystubs that falsely stated that his weekly pay included Limo Express’ 20% gratuity fee
  • Was never required to use any time tracking device, such as punch cards
  • Never received any notification regarding his rights under federal wage and hour law
  • Was required to purchase “tools of the trade” – including ties, shoes and a coat – with his own money

    • Because of the defendants’ pay practices, the suit alleges, the plaintiff’s effective rate of pay was reduced below the minimum wage. Furthermore, the plaintiff alleges he often worked 60 to 90 hours per week and was required to be available 24 hours per day for at least six days a week, but was never paid an overtime premium for his extra hours.
