Because of the defendants’ pay practices, the suit alleges, the plaintiff’s effective rate of pay was reduced below the minimum wage. Furthermore, the plaintiff alleges he often worked 60 to 90 hours per week and was required to be available 24 hours per day for at least six days a week, but was never paid an overtime premium for his extra hours.
