Moresca v. Visualscape Inc., et al
Filed: August 7, 2018 ◆§ 1:18cv23208
A former employee of Visualscape, Inc. claims he only received “some” of the wages allegedly owed to him for his overtime work.
Visualscape, Inc. and one individual with control of the business are facing a proposed collective action filed by a former employee who claims he only received “some” of the wages allegedly owed to him for his overtime work.
The plaintiff, who worked as a landscaper for the defendants from May 2017 to August 2018, claims he worked an average of 65 hours each week during his employment and was paid an average rate of $10 per hour. According to the lawsuit, the plaintiff wasn’t paid the extra half-time rate for 16 of the average 25 overtime hours he worked each week. Further, the suit claims he was not paid at all for nine of the 25 overtime hours. The plaintiff is seeking the half-time and time-and-a-half time wages that were allegedly withheld from him.
