Filed against Home Depot USA, Inc., the lawsuit argues that the home improvement chain maintains a practice of rounding employees’ recorded hours to their scheduled start and end times regardless of when they actually arrived at or left work. The plaintiff, who worked at the defendant’s Rancho Cordova location between June 2016 and May 2018, says this practice resulted in employees not being paid for time they spent working before and after their scheduled shifts.
Moreover, the case claims Home Depot failed to include earned bonuses in employees’ regular rates of pay when calculating their time-and-a-half overtime rates and thereby underpaid them for hours worked in excess of 40 each week.
