Accolade, Inc. is on the receiving end of a proposed class and collective action filed in Pennsylvania by a former employee who claims it failed to compensate its workers for all their over-40 overtime hours.
Accolade, Inc. is on the receiving end of a proposed class and collective action filed in Pennsylvania by a former employee. The suit claims the defendant, which provides health insurance administration services, failed to compensate its workers for all their over-40 overtime hours. The plaintiff allegedly worked for Accolade as a Health Assistant from April 2, 2012 through February 7, 2017, answering customer service calls regarding the health insurance plans offered by Accolade’s customers, i.e. employers. She says she regularly worked over 40 hours per week but did not receive any overtime wages until November 28, 2016, when Accolade changed its overtime policy.
Furthermore, the suit claims even after the new policy went into effect, the defendant failed to properly calculate employees’ overtime hours by routinely understating the amount of time they spent working. The plaintiff says she received five minutes’ “credit” each day to account for the time she spent logging in to her computer. In truth, the process ranged from five to 15 minutes in length, she claims. According to the suit, Accolade’s alleged miscalculations amounted to hours of unpaid overtime.
The suit seeks to cover all individuals who have worked for Accolade as Health Assistants any time during the past three years.
