Three former employees of National Auto Inspections, LLC have filed suit against the company claiming it failed to pay them proper overtime wages.
Three former employees of National Auto Inspections, LLC have filed suit against the company claiming it failed to pay them proper overtime wages. According to the complaint, the defendant (which the suit says trades as CARCHEX) operates a call center at which the plaintiffs were employed as vehicle protection specialists and were responsible for selling Extended Vehicle Protection Plans (EVPPs) to the defendant’s potential customers. The plaintiffs allege that they were paid on a piece-rate basis that included a minimum bi-monthly salary and various incentive bonuses – a structure the suit says “fostered an environment that promoted long hours.” Indeed, as a result of the defendant’s pay structure, employees would often work more than 40 hours per week to meet sales goals and bonus requirements, the complaint claims, but were unlawfully denied overtime pay for the hours they worked above 40.
