A former deliveryman has filed suit against two operating companies of Cory 1st Choice Home Delivery, CJJC Trucking Corp., and an individual owner over claims that he was not paid proper overtime wages.

A former deliveryman has filed suit against two operating companies of Cory 1st Choice Home Delivery, CJJC Trucking Corp., and an individual owner over claims that he was not paid proper overtime wages. The plaintiff says he worked for the defendants between July 2015 and June 2017 and was responsible for delivering furniture from a warehouse in Melville, New York to customers’ homes. According to the suit, the defendants exercised “significant control” over the plaintiff’s job duties and required him to work between 60 and 65 hours per week. The plaintiff claims he was paid a fixed rate of $100 per day regardless of the number of hours he worked and without receiving premium overtime pay for the hours he recorded beyond 40 each week.
The case further alleges the defendants failed to provide their employees with accurate wage statements as required by state and federal law.
