Assistcare Home Health Services LLC (which does business as Preferred Home Care of New York) is facing a proposed class and collective action filed by a former employee who claims the defendant failed to pay her proper wages.

Assistcare Home Health Services LLC (which does business as Preferred Home Care of New York) is facing a proposed class and collective action filed by a former employee who claims the defendant failed to pay her proper wages. The plaintiff says she worked for Assistcare as a home health aide between April 2012 and November 2016 without receiving proper overtime wages for working more than 40 hours per week and spread-of-hours wages for working more than 10 hours in one shift or non-consecutive hours in one workday.
The plaintiff also claims she was not paid for time spent traveling between clients’ residences when she cared for more than one client on the same day.
Furthermore, the suit alleges that the defendant failed to pay its employees in accordance with New York state’s Wage Parity Law, which the complaint says requires companies like Assistcare who receive Medicaid reimbursement to pay employees a “statutorily defined” minimum wage.
